Porky's Revenge - Part 1
Recently, da Manalapan Township Committee held a meeting and offered a special invitation to former mayor Porky Spodak to appear. At da meeting, Porky exercised his First Amendment rights, but also, through his fine investigating skills was able to catch 2 township committeepeople in doublespeak!
In response to Porky's claims of First Amendment issues at da meeting, Committeeman Cash Klauber replied, "We're not here to try to impinge on anyone's First Amendment rights."
Huh?????
Cash's claim was echoed by da Queen Mayor, "No one is looking to impinge on First Amendment speech."
Double Huh????
Did daTruthSquad miss something here????
Was it not daTruthSquad who received a subpoena from Google sent by da Manalapan Legal Dream Team to hand over their identity because da Manalapan Township Committee voted to know????
Was it not daTruthSquad who was taken to court in December because da Township Committee hired 4 lawyers at taxpayer expense -- a reality uncovered by da now-famous Rosman Editorial????
Was it not da TAXPAYERS of MANALAPAN who were paying for this legal challenge to da First Amendment brought by da Manalapan Legal Dream Team, da team of lawyers voted on by da Manalapan Township Committee to bring "Da Township of Manalapan vs Da Mosked Man" to trial????
Klauber: "We're not here to try to impinge on anyone's First Amendment rights."
da Queen: "No one is looking to impinge on First Amendment speech."
To paraphrase something Porky said, "If you say something enough, people may start to believe it."
Porky could not be any more right.
Don't believe for one minute that daTruthSquad, da TruthTellers, and our newest honorary TruthTeller Porky will forget that Manalapan's politicians have spent over $100,000 of taxpayer money on "Da Township of Manalapan vs Da Mosked Man," a land-deal-gone-bad / First Amendment lawsuit.
Never Forget Who Wants To Take Away YOUR Rights!
It's been nearly 2 months since Manalapan went to court, sending their now-famous Manalapan Legal Dream Team into Superior Court determined to erase da First Amendment from history.
Only one problem - they had to prove their case in front of an actual judge in an actual court, and as they found out, there's a big difference between an actual court of law presided by a law-abiding judge, and da Snoozepaper where only bad news about da Mosked Man seems to appear.
Since da Manalapan Legal Dream Team lost their first round against da Mosked man - at TAXPAYER EXPENSE - it seems like a total news blackout has been imposed by da Queen and her court. This makes sense because after numerous stories about da Mosked man in da Snoozepaper, it doesn't look good when you send your two best Dream Team lawyers to court, only to lose - at TAXPAYER EXPENSE.
Maybe that's why da Manalapan Township Committee is currently operating on "silent running."
Recntly, daTruthSquad found a blog site that reminded us all exactly what da case brought by da Queen Mayor, "Defendant" and alleged-Manalapan resident Andy Boy, and da Manalapan Legal Dream Team was about.
A new legal case being disputed in the small town of Manalapan, New Jersey, however, is a perfect example of what happens when you think you can use the law for your own ends. In this case, it's the town of Manalapan-or more specifically, local government officials-wanting to save face from a pesky local critic.
Officials in Manalapan has filed a subpoena for Google to disclose the true identity of "daTruthSquad," as well as communications, and "all other information associated with the account." The reasoning they give for their right to discovery of this identity and other information is that the lawyer himself, Moskovitz, is the actual writer of the blog in question.
However, Moskovitz has stated under penalty of perjury that he is in fact not "daTruthSquad". Despite this, the township continues to claim legitimacy for its discovery attempts, and refuses to withdraw the subpoena to Google for the blogger's identity.
Lawyers for the EFF filed a motion to quash the discovery subpoena, on the grounds that the blogger has a constitutional right to free speech, which isn't given up if he chooses to exercise it anonymously. There are many legal precedents for anonymous free speech that extend beyond print media, though anonymous free speech on the Internet is still a relatively untested issue.
EFF staff lawyer Matt Zimmerman said regarding the case, "Bloggers, as well as everyone else, have a First Amendment right to speak anonymously. Litigants don't get a blank check to pry into the private lives of critics when they say things the litigants don't like. The fact that it is the government trying to abuse the discovery process makes this attempted invasion of privacy all the more repugnant."
One recent case that would support the battle to protect anonymous blogger speech is the case of "Orthomom," a blogger who made critical comments against a county school board trustee who was the incumbent in a county election. In that case, the New York Supreme Court found that "[t]he relief sought by [the plaintiff], on the eve of a school board election, would have a chilling effect on protected political speech."
The EFF lawyer's statements ring true when it comes to determining the difference between a legally legitimate complaint and an illegitimate attempt to take away someone else's legal rights protected by the U.S. Constitution. In this case, it's pretty clear that the township of Manalapan hasn't got a leg to stand on.
Now, this "Total Lawyers" blog isn't written by some guy living in da gully along Woodward Road. These are REAL lawyers discussing REAL issues. Of course, this particular case has generated a lot of discussion not only in Manalapan, but throughout New Jersey, and news accounts show da story of "Da Township of Manalapan vs Da Mosked Man" has been written about or discussed on da radio in North America, South America, Europe, Asia, and Australia. Bloggers and news companies carried da story around da world with da kind of negative publicity that even da most capable public relations or "investor relations" firm couldn't stop if it tried.
DaTruth is, da case of "Da Township of Manalapan vs Da Mosked Man" is still going on, still costing taxpayers "in excess of $100,000," and that quote was 2 months ago. Since then, former Manalapan Mayor Andy Boy has become "Defendant" Andy Boy as he was served with papers by da Mosked Man in relation to this case. There is debate whether YOU DA TAXPAYER will be paying for Andy Boy's legal defense. It's a case that is closing in on being a year old and there is no end in sight to both da case and DA AMOUNT OF TAXPAYER MONEY BEING SPENT ON IT.
And, if you missed it, da Township Committee approved da official cleanup of da Dreyer Patch. That will cost da astronomical sum of $15,000 dollars.
Soon enough you will be receiving your next mortgage payment. That of course will be followed by a municipal tax bill. Remember, that municipal tax bill includes da "in excess of $100,000 for this case against da Mosked man. There are those who don't want you to know about it. There are those who do not report on it in their Snoozepaper so far this year at all, and there are those who hope you will forget about it.
Don't fear.
Thanks to Porky, da Manalapan Township Committee and da Gang of Three (hear no evil, speak no evil, and looking evil) were exposed as trying to cover up da First Amendment Fiasco they're making taxpayers pay for. If you forget, daTruthSquad will remind you. And, even if you don't read this blog, when you get your next tax bill you'll feel the reminder being siphoned from your wallot.
And that's daTruth.
In response to Porky's claims of First Amendment issues at da meeting, Committeeman Cash Klauber replied, "We're not here to try to impinge on anyone's First Amendment rights."

Dear truth,
You need to do a piece on the Double Standards that have been set forth here in Manalapan by the Queen, and her 2 loyal lap dogs. You have exposed the 1st Amendment Freedom of Speech one but you really must add the No Mega Mall connection to the Queen and her loyalists. I think you will find most interestingly how the double standard applies there. You have only scratched the surface. Let's also talk about the synthetic turf field. NYC is nixing spending 25MILLION DOLLARS on the additional fields they planned to install. Let's see the "SPIN" the Queen puts on the field being installed in Manalapan. You see the same brand of field Manalapan is putting in is the same brand of field NYC has nixed installing. Will thre Queen and her lap ogs finally listen to Gennaro and nix tghe field here? If they don't you must ask them why?
da truth squad is like Superman and can save Manalapan from Dr. Evil and her lapdogs. Keep digging da truth squad to free Manalapan from the evil grip of these lowest form of scum.
GOD BLESS da Truth Squad !
da truth squad is my hero.
Dear The Truth Squad,
While I was using the snowblower to clear my driveway on Friday it sucked up that rag the snoozer. The snoozer jammed and crack a piece of the snowblower. Can I take the snoozer to small claims court to cover the repairs to the snowblower ? How can I opt out from having the snoozer throw that trashy rag of a paper and litter my driveway. Isn't there a law ?
What happens if someone trips and falls on that rag ?
Why does every other publication come in the mail or is put by the mailbox except the snoozer ?? The Town council should pass a law against throwing trash on the driveway unless the home owner orders it. I'll bet they won't even consider it since the snoozer is in the pocket of the losers in power in Manalapan What a shame.
Signed snowblowerless in Manalapan.
I was just wondering. If the truth squad is read all over the world and is supposed to have 1500 page hits per month/day/week whatever... how come the can't do better than three comments (including mine). My guess is that people read it as a horrible joke and move on with their lives.
You are right. The opinions here are just one or two egomanics repeating their sad stories over and over and over. With the time Da Truth Squad has put into these bloggins he could have cured cancer already. Imagine all the time and effort he has put into this site. Why? Would you spend hours and hours a day blogging if you didn't have something to gain from it personally. Or maybe this site is the most altruistic site on the internet...Which makes more sense to you?
With all of the time someone has had to delete nearly every post on NJ.com, that person could have cured cancer. It seems like a Roth supporter has been very busy there monitoring that site by the hour.
I must report the city discussed about this blog is quite telling. We may not have every freedom you enjoy, but politics of local America seem to leave much to be desired.
I first found this blog from Slashdot and from another blog I read. It is quite shame your government resort to measures of taking away freedom rights to stop you and now others who write about it.
Fight against propoganda that the local government seems to do. And I will keep reading this blog.
da truth squad is the BEST in the World !
The former mayor went ot the podium and spoke. He said he had proof that there was something illegal about the zone changing in manalapan from commercial office to a village center. Called it spot zoning. Well my question is this, where did he get his documents from for his proof? Did he OPRA request his information? If he did then wouldn't the mayor have known in advance what he was OPRAing? It seems that Manalapan has one of the best clerks offices in the county if not thee best and the mayor would have known what was being requested. I think the lady mayor has alot of explaining to do. Don't you? After all she said she knew not why he was there for or did she? Were the tax payers of Manalapan duped once again?
it really doesn't matter how he got the documents. Every six months another democrat claims the zoning was illegal. It wasn't. It's been looked at so many times, it's probably the cleanest rezoning in Manalapan, unlike the neighborhood rezoned by the former mayor who first claimed the village center rezoning was illegal, and then moved into the development he rezoned to increase the density, bringing millions to the pockets of the developer who then "sold" him his house. Maybe we should start investigating a rezoning that WAS illegal, instead of the same legal zoning that's been looked at a dozen times.
nj.com has become meaningless as a public forum. I have posted there as Schrute and Karma. I have not violated any of the rules of the forum with any of my posts. I HAVE criticized the arbitray censorship -- and each and every critical post has been deleted. The old Communist Russia? No, just the Manalapan forum on nj.com. Someone has a great deal of influence over there. I suggest we all stop posting over there and render them useless. Then the ex-mayor would have one less thing to complain about. (And can anyone explain to me why the 3 members of the TC felt the need to "apologize" to him for the comments of others?)
I don't even post at NJ.com anymore. Every post I put there was also mysteriously taken down. NJ.com is meaningless I agree.
At least here the posts remain, even those that say bad things about datruthsquad. That is what the First Amendment is all about, and that is why I post here. Thank you datruthsquad for giving the residents of Manalapan a true forum to speak what we believe.
This post will disappear I can guarantee.
Da FRAUD SQUAD is a liar and a loser. This blog is nothing more than the rantings of the followers of Stu Moskovitz.
It is the 1 person who posts under 15 names on NJ.com that has all of the posts deleted. That 1 person is the one taking the first amendment away from everyone else. This is the irrevelent forum.
oh george, shut up already. Only you can bore an entire community of 37,000 people all at once. You did nothing as mayor except line your own pockets. Stop pretending you're acting in the public interest. You're an obsessed senile bore.
So who is the person whose name couldn't be posted on njo.com?
Suetonius
hey how are those truth squad t shirt sales going? Cause I haven't seen one!!!
I went to the mall last week I saw at least 37 people wearing the t-shirts. Open your eyes fool.
I tuned in to nj.com to see if they are still deleting posts -- and they had just deleted a whole thread between Wyatt and someone else (I can't remember now). Anyway since Manalapan has become useless I decided to check out other towns to see what was being said. And my question now is "Why does everyone pick on Manalapan?" I was reading the South River forum and the Old Bridge forum. In South River -- they are arguing over the fire chief bringing his kids in the official fire vehicle on his way to a fire. In Old Bridge -- they are arguing over the bus driver lady who got a job (Level 7??) teaching in the school -- her husband is a board member.
So if you ask me -- every town has their issues and disagreements. Why does everyone (and by that I mean that Bean guy) insult Manalapan with that "eating their young" comment? If he was an objective reporter -- wouldn't he check out if the same thing is happening in other towns -- and not single us out?
By the way this is Schrute.
Hey "Oh george shut up" poster,
Check this link out. Then keep it up fool.
